By placing an order you confirm that you are capable of entering into legally binding contracts and you are at least 18 years old. We will not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18, and we reserve the right not to deliver if we are unsure of this.
1. Introduction
Welcome to Terroir Sommelier. These Terms and Conditions govern your use of our website and services. By accessing our website and/or purchasing products from us, you agree to be bound by these Terms and Conditions.
Terroir Sommelier is a curated wine subscription service that delivers personalized wine selections to your door. Our AI-powered sommelier recommends wines based on your preferences and taste profile.
2. Definitions
- "We", "Us", "Our" refers to Terroir Sommelier
- "You", "Your" refers to the customer or user of our service
- "Subscription" refers to our monthly wine delivery service
- "Products" refers to wines and related items sold through our service
- "Website" refers to terroir-sommelier.com
3. Age Verification
You must be at least 18 years old to purchase alcohol from us. By placing an order, you confirm that:
- You are at least 18 years of age
- You are legally able to purchase and receive alcohol
- You will ensure someone over 18 is present to receive the delivery
- You understand that proof of age may be required at delivery
We reserve the right to refuse delivery if we have reasonable doubt about the age of the recipient. Our delivery partners may request valid photographic ID (passport, driving licence, or PASS card) before handing over the package.
4. Subscription Plans
4.1 Available Plans
We offer three subscription tiers:
- Explorer Plan: 2 bottles per month (£80 + £9.95 P&P)
- Connoisseur Plan: 3 bottles per month (£110 + £9.95 P&P)
- Cellar Master Plan: 4 bottles per month (£140, includes free P&P)
4.2 Subscription Terms
- Subscriptions are billed monthly in advance
- Your first delivery will be sent within 7-10 working days of subscription
- Subsequent deliveries are dispatched on the 25th of each month
- Wine selections are personalized based on your taste preferences
- You will receive notification emails on the 5th of each month detailing your wine selection
4.3 Cancellation Policy
- You may cancel your subscription at any time from your account dashboard
- Cancellation must be made at least 5 days before the 25th to avoid the next month's charge
- Upon cancellation, you will continue to receive your subscription until the end of your current billing period
- No refunds are available for partial months
5. Orders and Payment
5.1 Order Acceptance
All orders are subject to acceptance and availability. We reserve the right to refuse any order at our discretion. When you place an order, you will receive an email confirmation. This does not mean your order has been accepted - acceptance occurs when we dispatch your order.
5.2 Pricing
- All prices are in GBP (£) and include VAT where applicable
- Prices may change without notice, but changes will not affect orders already confirmed
- Delivery charges are clearly stated before checkout
- We reserve the right to correct pricing errors on our website or on pending orders
5.3 Payment
- Payment is processed securely through Stripe
- We accept major credit and debit cards
- Payment is taken at the time of order/subscription setup
- For subscriptions, recurring payments are processed automatically on the same date each month
- You are responsible for ensuring sufficient funds are available
5.4 Failed Payments
If a payment fails, we will notify you and attempt to process payment again. If payment continues to fail, your subscription may be suspended or cancelled after 7 days.
6. Delivery
6.1 Delivery Times
- Monthly subscriptions are dispatched on the 25th of each month
- Standard delivery takes 3-5 working days
- We only deliver within the UK mainland
- Delivery times are estimates and not guaranteed
6.2 Delivery Address
- You are responsible for providing accurate delivery information
- We cannot deliver to PO Box addresses
- If you are not present to receive delivery, the courier will leave a card with instructions
- Parcels must be signed for by someone over 18
6.3 Failed Delivery
If delivery fails due to:
- Incorrect address provided by you
- No one over 18 available to receive the delivery
- Refusal to accept delivery
You will be responsible for additional delivery charges or collection costs.
6.4 Risk and Title
Risk passes to you when the goods are delivered to your address. Title passes when we receive payment in full.
7. Returns and Refunds
7.1 Faulty or Damaged Goods
If your delivery arrives damaged or faulty:
- Contact us within 48 hours of delivery
- Provide photographic evidence of the damage
- We will arrange a replacement or refund
- Do not dispose of damaged items until instructed
7.2 Incorrect Orders
If we send you incorrect items, contact us within 48 hours and we will arrange collection and replacement at no cost to you.
7.3 No Refunds Policy
All sales are final. We do not offer refunds on wine purchases or subscription fees except in cases of faulty or damaged goods as outlined in section 7.1, or incorrect orders as outlined in section 7.2.
By purchasing from Terroir Sommelier, you acknowledge and accept that:
- Wine is a perishable product with subjective taste preferences
- Personal taste preferences do not constitute grounds for a refund
- Subscription fees are non-refundable once processed
- You may cancel future subscription renewals at any time, but no refund will be provided for the current billing period
7.4 Consumer Rights & Cancellation
Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days. However, there are important exemptions that apply to our service:
You CAN cancel and receive a full refund if:
- You cancel your order BEFORE it has been dispatched
- The wine is faulty or damaged (as per section 7.1)
- We sent you the wrong items (as per section 7.2)
You CANNOT cancel or receive a refund if:
- The wine has been dispatched (as our selections are personalized to your taste profile)
- Any seal on a bottle has been broken or the wine has been consumed
- You simply don't like the taste (wine preference is subjective)
- The current subscription billing period has already started
To cancel an order before dispatch, please contact us immediately at support@terroir-sommelier.com. Once dispatched, our no refunds policy applies except for faulty, damaged, or incorrect items.
7.5 Non-Refundable Items
We cannot accept returns of:
- Opened or consumed wine bottles
- Personalized or custom orders
- Products damaged through your negligence
- Wines you simply don't like (taste preference is subjective)
- Subscription fees for completed billing periods
8. Product Information
8.1 Product Descriptions
We make every effort to ensure product descriptions are accurate. However:
- Vintages may vary due to availability
- Tasting notes are subjective and based on expert opinion
- Bottle designs and labels may differ from images shown
- We reserve the right to substitute wines of equal or greater value if necessary
8.2 Allergen Information
Wine may contain sulfites and other allergens. Please check individual product pages for allergen information. If you have specific dietary requirements, please contact us before ordering.
9. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is our property or that of our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our written permission.
10. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the value of your order
- We are not liable for delays caused by circumstances beyond our control
- Nothing in these terms limits liability for death or personal injury caused by negligence
11. Data Protection and Privacy

13. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
14. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
